Prepare Term Sheet


To begin, click on one of the following two alternatives to specify whether you (as the First Party) are proposing to accept money to settle the claim or are, alternatively, proposing to pay money to settle the claim:

(If you are an attorney or an agent for the First Party and have been authorized by the First Party to do so, you may enter the words "In Care of" or "C/ O" followed by your name and mailing address.)

(If you are an attorney or an agent for the First Party and have been authorized by the First Party to do so, you may enter your own email address.)

(If the First Party is issuing the Invitation to the Second Party in care of an attorney for the Second Party or in care of someone otherwise duly authorized to act for the Second Party, then you may enter the words "In Care of" or "C/ O" followed by that attorney or agent's name and mailing address.)

(If the First Party is issuing the Invitation to the Second Party in care of an attorney for the Second Party or in care of someone otherwise duly authorized to act for the Second Party, then you may enter that attorney or agent's email address.)

(e.g., "The claim referred to in Attorney Roe's letter to John Smith dated January 4, 2017," or "ACME Insurance Claim No. 12345," or "All claims that were or that could have been raised in the case of Doe v. Smith, Civil Action No. 678910.")

(i.e., specify the date and time at which the First Party's willingness to settle the claim via the System would come to an end. The deadline must be at least seven (7) calendar days after the date upon which the Invitation is activated. The deadline will be set at 12:00 Hours (i.e., 12:00 Noon) U.S. Eastern Standard Time on the date you specify.)

Note 1: In the event that Fair Outcomes, Inc. determines that the System was previously used to issue an Invitation with respect to the claim in question then Fair Outcomes, Inc. will, if the Second Party identified in the more recent invitation objects in writing to the System being used again with respect to that claim, deactivate the later Invitation.

Note 2: If you are not an attorney it is recommended that you obtain advice from an attorney with respect to how best to identify the parties and describe the claim, and as to what might constitute a reasonable and realistic deadline given the underlying facts and circumstances.
